Definitions

In these Terms and Conditions, the following terms have the following meanings:

"Bot" means AnyHouse chatbot, hosted in Telegram.

"Feedback" means ideas, feedback, or innovations that are provided by You regarding the improvements of our Service.

"Service Provider" (or "the Service Provider," "We," "Us," "Our") refers to AnyHouse.

"Services" means all the features offered to the User through the Website and Bot.

"Subscription" refers to the services or access to the Service offered on a subscription basis by the Service Provider to You.

"Telegram" refers to the Telegram messenger, available from https://telegram.org or their mobile application.

"Terms and Conditions" (or "Terms," “TOS”) mean these Terms and Conditions that form the entire agreement between You and the Service Provider regarding the use of the Service.

"Users" collectively refer to all individuals, companies, or other legal entities accessing or using the Service, as described in the singular term "User."

"Website" refers to the AnyHouse website, accessible from https://anyhouse.me.

"You" (or “User”) refers to the individual who accesses or uses the Service, or to the Service Provider or other legal entity on whose behalf the individual is accessing or using the Service, as applicable.

Description of the Service

Our Service, a chatbot, is designed to assist Users in locating rental properties. This chatbot aids Users in identifying suitable rental properties by filtering property advertisements sourced from various internet

platforms and delivering personalized notifications within the chatbot. Users possess the ability to configure their filters and criteria within the Bot. The Bot is accessible through the Telegram platform and can be accessed via our Website.

Subscriptions (AnyHouse Premium)

Some parts of the Service are available only with a paid Subscription. The extended functionality is accessible inside the Bot, and solely for Users with an active and paid Subscription. It includes additional property searching filters, a scan of additional property search platforms, and also may include limited access to a beta version functionality of the Service. Payments are processed and handled by Stripe (our payment service provider). Users are charged in advance on a recurring and periodic basis (e.g., daily, weekly, monthly, or annually), depending on the specific Subscription plan they choose at the time of Subscription purchase.

Subscription cancellations and refunds

The User can cancel the renewal of their Subscription either through our Bot or by reaching out to the Service Provider via their Telegram account. Please note that the User will not receive a refund for any fees they have already paid for their Subscription periods, and they will retain access to the Service until the expiration of their current Subscription period.

Subscription fee changes

The Service Provider, in its sole discretion and at any time, may modify the Subscription fees. Any Subscription fee change will become effective at the end of the then-current Subscription period.

The Service Provider will provide You with reasonable prior notice of any change in Subscription fees to give You an opportunity to terminate Your Subscription before such change becomes effective.

Your continued use of the Service after the Subscription fee change comes into effect constitutes Your agreement to pay the modified Subscription fee amount.

Free Trial

The Service Provider may offer a Subscription that includes a Free Trial for a limited period of time at its sole discretion.

During the Free Trial, you will have full access to the Subscription's features. The Free Trial will automatically expire at the end of the specified period. Unless you subscribe to a paid plan before the end of the Free Trial, your Subscription will automatically be downgraded to our free plan, which may offer limited features compared to the paid Subscription.

The Service Provider reserves the right, at any time and without notice, to modify the terms and conditions of the Free Trial offer or to cancel the Free Trial offer.

Links to other websites

Our service may include links to third-party websites, including but not limited to links to specific rental property ads. We want to emphasize that we have no control over these websites' content, privacy policies, or practices. Therefore, we disclaim any responsibility or liability for the materials, information, products, or services displayed or offered on these third-party websites. You acknowledge and agree that your use of such links is solely at your own risk, and we encourage you to review the terms and privacy policies of any third-party websites you visit through our service.

Data Protection and Privacy

Users are informed that the personal data collected may undergo data processing in compliance with relevant data protection laws and regulations. For comprehensive information regarding the usage of your personal data and your associated rights, we advise you to review our Privacy Policy

Termination

The Service Provider reserves the right to terminate a User's access to the Service or forcibly stop their Subscription for any reason, including but not limited to a violation of these Terms of Service. In cases of termination, the Service Provider will make reasonable efforts to notify the User, provided that the User has left open contact information.

Platform Integrity

Users are strictly prohibited from taking any actions that could potentially harm, disrupt, or compromise the integrity, functionality, or performance of the Service. These actions encompass but are not limited to, attempting unauthorized access to the Service or its systems, utilizing automated means to access or employ the Service, uploading or transmitting malicious software or viruses, or interfering with the proper functioning of the Service.

Lawful Conduct

Users are required to use the Service in strict accordance with all applicable laws, regulations, and rules. Usage of the Service for any unlawful, fraudulent, or harmful activities, including but not limited to infringement of intellectual property rights, harassment, defamation, or invasion of privacy, is strictly prohibited.

Intellectual Property

The Service Provider and its licensors retain exclusive rights to all trademarks, logos, and other media and materials associated with the Service. Users are strictly prohibited from using any of the Service Provider’s intellectual property without explicit permission.

Indemnification, Warranty Exclusion, and Liability

The Service is provided 'as is.' Consequently, the Service Provider does not offer you any guarantee concerning it, and in particular concerning: The conformity of our Service to your expectations; The absence of interruption, errors, security breaches, or infringement of the rights of third parties in the operation of the Service; The accuracy and reliability of information obtained through the use of our Service. More generally, you acknowledge that the Internet and any telematic network used for data transmission may involve risks related to the lack of protection of certain data against possible misuse and risks of contamination by viruses. Also, the Service Provider cannot be held responsible for the loss or alteration of data, or for the loss of opportunity or time. In any event, our liability is limited to direct material damages to the exclusion of any indirect damages of any kind. We further reserve the right, to the extent permitted by law, to modify, suspend, discontinue, or limit the availability of all or any part of our Service for business and operational reasons at any time without notice.

Users’ Feedback

By providing any feedback, ideas, suggestions, or other information ("Feedback") to us regarding our Service, you grant us an unrestricted, irrevocable, royalty-free, perpetual, and worldwide license to use, modify, adapt, publish, translate, create derivative works from, distribute, and display such Feedback in any form, media, or technology, without acknowledgment of you as the source or author and without any obligation to compensate you. You expressly waive any claims to royalties or any other compensation arising from our use of the Feedback. This Feedback may be used for any purpose, including but not limited to product development, enhancements, or marketing, without any limitations or restrictions.

Applicable laws and jurisdiction

In case of any dispute or disagreement related to these conditions, the parties agree to abide by Dutch law and submit exclusively to the jurisdiction of the courts in the Netherlands. They waive any rights to seek resolution in other jurisdictions.

Disputes Resolution

Modification of these TOS

We reserve the right to update or modify these TOS at any time. Any changes will be effective immediately upon being posted on our website. It is your responsibility to regularly check our website for updates to these Terms of Service. Your continued use of our service after the posting of any changes constitutes your acceptance of those changes. If you do not agree to any modifications, you must stop using our service.
